Article 1 – Purpose

The purpose of these GTC is to define the rights and obligations of the parties in connection with the online sale of products offered on the website.


Article 2 – Products

The products offered for sale are those listed on the website on the day it is consulted by the customer.

Each product is subject to a detailed description allowing the customer to know its main characteristics.

The photographs, visuals, descriptions and staging present on the website are provided for informational purposes only and are not contractual.

Slight variations may exist between the visuals presented and the product delivered, particularly due to screen settings, materials or manufacturing.


Article 3 – Prices

Prices displayed on the website are indicated in euros (€), all taxes included.

The brand reserves the right to modify its prices at any time. However, the price invoiced to the customer will correspond to the price displayed at the time of order validation.

Delivery costs are added at the time of payment and depend on the weight, the chosen carrier and the destination.

Article 4 – Orders

Any order placed on the website constitutes acceptance of the prices, descriptions and these GTC.

The customer receives a confirmation email once the order is validated.

The brand reserves the right to refuse or cancel any order in the event of:

  • Previous dispute with the customer
  • Payment default
  • Incomplete or incorrect information
  • Suspicion of fraud
  • Exceptional unavailability of a product

Article 5 – Product Availability

Products are offered within the limits of available stock.

In case of unavailability after order validation, the customer will be informed as soon as possible. The brand may then propose:

  • An exchange
  • A credit note
  • Cancellation of the affected order

Article 6 – Payment

Payment is made online at the time of order.

Accepted payment methods include:

  • PayPal

Payments are secured via the payment providers used on the website. The order will only be prepared after full payment validation.


Article 7 – Delivery

Products are delivered in mainland France, Europe and the DOM-TOM (French overseas departments and territories), subject to serviced areas.

Orders are prepared within an estimated timeframe of 5 to 7 working days. Shipments are made on Tuesdays and Fridays.

Once shipped, the order is generally delivered within an estimated timeframe of 7 to 10 working days.

Delivery times are indicative and may vary depending on the destination, carrier or periods of high activity. The brand cannot be held responsible for delays attributable to the carrier.

Article 8 – Receipt of Orders

The customer is required to check the condition of the package and products upon receipt.

In case of apparent anomaly, damaged package or missing product, the customer must contact customer service as soon as possible at: contact@delphinuscreation.com


Article 9 – Right of Withdrawal

In accordance with current regulations, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal.

Any request must be addressed to customer service before any return.

The returned product must be unworn, unwashed, undamaged, returned in its original packaging and accompanied by its labels.

When a return is accepted, the customer may request:

  • An exchange
  • A credit note valid on the store
  • A refund in accordance with the applicable right of withdrawal

Return shipping costs remain the responsibility of the customer. Any refund is made after receipt, inspection and validation of the returned product.

Article 10 – Products Excluded from Return

The following cannot be exchanged or subject to a credit note:

  • Personalized products
  • Underwear
  • Accessories
  • Sale or promotional products
  • Gift cards

Article 11 – Liability

The brand cannot be held responsible for damages resulting from improper use of the purchased product, nor in case of:

  • Force majeure
  • Disruption of postal services or carriers
  • Abnormal use of the website
  • Customer input error

Article 12 – Intellectual Property

All content present on the website is protected by intellectual property law.

The DELPHINUS brand, its logo, its monogram, its signage, its visuals, its texts, its photographs, its graphic elements and all the content of the website remain the exclusive property of DELPHINUS.

Any reproduction, exploitation, resale or use without prior written authorization is prohibited.


Article 13 – Personal Data

Personal data collected in the context of orders are processed in accordance with the Privacy and Personal Data Protection Policy.

The customer has rights of access, rectification, deletion and opposition concerning their data.


Article 14 – Pre-orders

Certain products may be offered for pre-order. Specific deadlines related to these products will be indicated directly on the relevant product pages.

An order containing a pre-ordered product may be shipped in a single delivery once all products are available.


Article 15 – Gift Cards

If gift cards are offered on the website, they cannot be exchanged, refunded or converted into cash. Their conditions of use will be specified at the time of their sale.


Article 16 – Applicable Law and Disputes

These GTC are subject to French law.

In the event of a dispute, an amicable solution will be favored before any legal proceedings. The customer may also have free recourse to a consumer mediator:
